“ Rest assured - this is a SCAM. I also received a phone call from a Middle Eastern man named "Kevin Williams." This person calls claiming to be from the Brian Cave Law Offices based out of New York, NY. He is informing you of a law suit that will be filed against you the following morning on behalf of a large company by the name of "Cash Advance/Advance America/AAC Advances" (he keeps switching between names) He says that the company is a larger loan company that houses loans for smaller loan companies and will name drop several more, well known loan company names - including one that you have done business with. Be careful - this is all information that can generally be found online or if a database at a company is hacked, your information may have been leaked. He was unable to tell me the dates of my loan and tried using large amounts of legal jargon to sound legitimate. It's obvious that he was not from a law office as he would say a legal phrase, ask me if I understood what that was, and when I said no - he would cite what sounded exactly like a lengthy dictionary entry. Many phrases will be thrown around, like "an arrest warrant will be issued" or "Let me read you this affidavit, do not interrupt me as it will be recorded on a FEDERAL line" or "We will file an OOCR - do you know what that is? That is....." No lawyer will talk to you like that. AND an arrest warrant cannot be issued for not paying a debt. It can only be issued for not following court orders, including showing up for a debtor's examination, etc. And that will only occur if no wages, income or assets are found to be able to be garnished. So if you have wages and they aren't garnished, this isn't something that can occur. "Kevin" also tried telling me that in my contract with company XYZ it is agreed that the only form of communication will be through email. Legal matters must be sent to you via physical, paper documents. If you've moved there is a chance that you never got the documents, but none of this will be strictly email based. I played his game and told him that the reason the loan wasn't paid was because I already paid a separate collection company for the loan, and he said I must have paid the wrong company. He took "the FEDERAL recording" of my story and all information I gave him and "consulted his Legal Team" to see if he could somehow manage to arrange for us not to go to court and settle for a payment in full, or a large amount paid RIGHT AWAY. He left me on hold for about 10 minutes, and after returning told me that he had GREAT NEWS - they will accept my payment of 300.00 same day and the remainder of my amount owed next week, and even commented "Isn't that COOL?" He told me that the payment had to made immediately as there was no way for them to NOT take the paperwork down to the courts the next day without the confirmation number from my payment. This is not how the process works - they have the choice to file or not file. They can hold a document indefinitely and until they file the paperwork, there are no deadlines set by the court. Don't fall for his sense of urgency. When it came to the matter of payment - only a money order or money gram could be accepted (after I waited on hold for him to consult his finance department) When I asked why a debit card couldn't be used as it was an immediate form of payment, he had no legitimate answer. THIS IS A HUGE TIP OFF - over seas scams generally require payment via money gram because it is immediate for them and basically untraceable once received. After I told him I was on my way to the money gram location and hung up - I looked up the Brian Cave Law Offices in NYNY, called the number on file and the receptionist confirmed that this was a common scam using the name of their offices. After all was said and done I told "Kevin" that I knew it was a scam and to never call me again. About an hour later I received a phone call from my local police department and an officer named "Robert Peterson." He gave me his badge number and claimed to be addressing my claims that the representative was calling fraudulently. Funny thing - it sounded just like "Kevin." I called my local Police Department and the representative confirmed that the badge number was flase and that people can esaily change or mask their caller ID name. SO DO NOT FALL FOR IT. If you are concerned about your credit or a debtor - pull up your credit report at freecreditreport.com and look for the debt collector's names. You can call the legitimate business and handle the affair on your own without responding to a false company taking your money. GOOD LUCK ”

“ If this person calls you the odds are they already have your SS# etc. so you better change your bank records etc. He calls and says he is from a law office and that you need to contact your attorney because you are either being sued or arrested. The number comes out of New York, NY Brooklyn area. When he called a person I know he already had all her info bank account number everything, and told her she was being sued for a $2,000 hot check she wrote when #1 she doesn't write checks, #2 she has never been to NY. ”
